What Happens If You Miss the Income Tax Filing Deadline?

Filing an Income Tax Return (ITR) within the prescribed deadline is a statutory responsibility for eligible taxpayers. Failure to comply with these timelines can result in monetary penalties, interest on outstanding taxes, delayed refunds, and restrictions on carrying forward certain losses. This guide outlines the applicable rules, timelines, and procedures under the Income Tax Act, 1961.

Penalties and Interest for Late Filing

As per Section 234F of the Income Tax Act:

  • If total income ≤ ₹5 lakh: ₹1,000 penalty (if filed after the due date but before December 31)
  • If total income > ₹5 lakh: ₹5,000 penalty (if filed after the due date but before December 31)
  • If filed after December 31: ₹10,000 penalty (if income > ₹5 lakh)

Interest under Section 234A is levied at 1% per month or part thereof on the outstanding tax amount from the original due date until the date of filing.

Filing a Belated Return (Section 139(4))

A belated return can be filed if the original deadline has passed. Key points:

  • Permitted until December 31 of the assessment year
  • Losses (e.g., capital or business losses) cannot be carried forward if filed late
  • Interest and penalties apply

Impact on Refunds (Section 244A)

Filing a belated return does not forfeit the refund itself; however:

  • Interest on refund may be reduced or disallowed depending on timing and conditions
  • Refund processing may be delayed relative to timely returns

Note: Interest under Section 244A is only payable if the refund amount exceeds 10% of the total tax paid.

Correcting Errors After Missed Deadline

  • Revised Return (Section 139(5)): Can be submitted until December 31 of the assessment year
  • Rectification (Section 143(1)): May be filed if the return has already been processed and an intimation received

Preventive Measures

  • Track key deadlines annually
  • Maintain records like Form 16, TDS certificates, and bank statements
  • Use registered tax-filing platforms or consult authorised professionals
  • File voluntarily even if income is below the taxable threshold, to support loan or visa applications
